Terms of Service

These Terms of Service ("Terms") govern your use of BackupFort portal, dashboard, APIs, and related backup services provided by iGears Technology Limited ("BackupFort", "we", "our"). By creating an account or using the service, you agree to these Terms.

1. Eligibility and Account Responsibilities

  • You must provide accurate registration information and keep it updated.
  • You are responsible for all activities under your account, including device enrollment, API key usage, and backup/restore operations.
  • You must maintain credential confidentiality and notify support promptly if unauthorized access is suspected.

2. Service Scope

  • BackupFort provides tooling to register devices, schedule and run backup jobs, perform restore jobs, and manage account, billing, and policy settings.
  • Service features may differ by plan, region, deployment model, or product release stage.
  • We may introduce, change, or discontinue features to improve security, reliability, and compliance.

3. Acceptable Use

  • You may not use the service for unlawful content, unauthorized data access, malware delivery, abusive automation, or activities that harm service integrity.
  • You may not attempt to bypass rate limits, authentication controls, or access restrictions.
  • You are responsible for obtaining all rights/consents needed for data you back up and restore.

4. Data Ownership and License

  • You retain ownership of your data and content.
  • You grant BackupFort a limited license to process, transmit, and store data solely to provide and secure the service.
  • We do not claim ownership of your backup content.

5. Security and Operational Controls

  • You should use strong passwords, secure endpoints, and rotate/revoke API keys when needed.
  • We may suspend tokens, keys, jobs, or accounts if we detect suspicious activity, abuse, or policy violations.
  • Maintenance windows or incident response actions may temporarily impact availability.

6. Billing, Upgrades, and Renewals

  • Paid plans are billed according to the pricing and billing cycle shown in the portal at purchase time.
  • Payment processing and invoice handling may be provided by third-party billing processors.
  • Plan changes, renewals, and cancellations are governed by plan terms and applicable payment processor rules.

7. Suspension and Termination

  • You may stop using the service and request account deletion per portal capabilities and legal constraints.
  • We may suspend or terminate access for material breach, legal requirements, non-payment, or security risk.
  • Upon termination, access may be disabled and data may be deleted or retained as required by law, policy, or dispute handling.

8. Warranties and Disclaimers

  • The service is provided on an "as is" and "as available" basis to the extent permitted by law.
  • We do not guarantee uninterrupted operation, error-free behavior, or that every backup/restore objective will be met without customer-side validation.
  • You should test restore procedures regularly and maintain operational safeguards for business continuity.

9. Limitation of Liability

  • To the maximum extent permitted by law, BackupFort is not liable for indirect, incidental, special, consequential, or punitive damages.
  • Total liability for direct damages is limited to amounts paid for the applicable service period, unless otherwise required by law.
  • Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Governing Terms and Changes

  • These Terms, together with the Privacy Policy and plan-specific terms, form the agreement between you and BackupFort.
  • We may update these Terms. Continued use after an effective update constitutes acceptance of the revised Terms.
